Terms and Conditions

These Terms & Conditions (“Terms”) govern your use of EduLink, including all tutoring sessions, group classes, digital products, and related services offered through our website. By accessing or using EduLink, you agree to be bound by these Terms, our Refund & Cancellation Policy, and our Code of Conduct. If you do not agree with any part of these Terms, you must discontinue use of the platform immediately.

1. Acceptance of Terms

By creating an account, booking a session, attending a class, viewing digital content, or using any EduLink services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions. EduLink reserves the right to update these Terms at any time. Continued use of the platform after updates constitutes acceptance of the revised Terms.

2. Our Services

EduLink provides access to a range of educational services including private tutoring sessions, small and large group classes, pre-recorded lessons, worksheets, and other educational materials. While EduLink strives to provide high-quality academic support, we do not guarantee any specific learning outcomes, grades, exam results, or academic achievements. Progress and results depend on student participation, consistency, effort, and study habits.

3. User Accounts

To access EduLink services, users must create an account. You agree to provide accurate, updated personal information and maintain the confidentiality of your login details. You are responsible for all activity occurring under your account. EduLink is not liable for unauthorised usage due to weak passwords, shared accounts, or negligence. Users must notify EduLink immediately of any suspected security breach or unauthorised access.

4. Bookings and Payments

Sessions must be booked through the EduLink website. Bookings are only confirmed once payment has been successfully received. EduLink accepts a range of payment methods which may include debit/credit cards, PayPal, MMG, bank transfer, or other approved channels. All pricing is listed in the stated currency, and EduLink reserves the right to adjust pricing at any time. Users are responsible for ensuring payment is submitted correctly before the session begins.

5. Cancellation, Reschedule, and Refund Policy

All cancellations, rescheduling rules, and refund eligibility are strictly governed by EduLink’s Refund & Cancellation Policy, which forms an integral part of these Terms. By completing a booking, users acknowledge and accept the rules concerning free cancellations, late cancellations, no-shows, technical difficulties, package refunds, and digital product refund restrictions. Refunds will not be provided outside of the defined policy.

6. Tutor Responsibilities

Tutors operating through EduLink agree to maintain a professional environment at all times. Tutors are expected to start sessions promptly, remain prepared with relevant materials, and provide instruction consistent with EduLink’s guidelines. Tutors function as independent contractors, not employees of EduLink. As such, they are responsible for their own tax reporting and professional conduct. EduLink reserves the right to temporarily suspend or permanently remove any tutor who fails to meet service quality standards, receives repeated complaints, or violates platform policies.

7. Student and Parent Responsibilities

Students and parents must ensure punctual attendance, respectful behaviour, and appropriate engagement during sessions. Parents are responsible for ensuring the student has reliable internet access, functioning equipment, and a quiet learning environment. Disruptive or inappropriate behaviour may result in students being removed from live sessions or denied future access. Parents must supervise younger children when necessary to maintain session quality and safety.

8. Intellectual Property Rights

All content provided through EduLink, including worksheets, lesson materials, course videos, graphics, recordings, and digital products, is protected by intellectual property rights and remains the property of EduLink or the respective tutor. Users may not copy, distribute, record, sell, modify, upload, or share class materials without written permission. Any unauthorised use of intellectual property may result in account termination and potential legal action.

9. Use of Session Recordings

Some live sessions may be recorded for training, safety monitoring, or to provide playback access to students. By using EduLink, you consent to being included in session recordings when applicable. Recordings are confidential and stored securely. Users are strictly prohibited from recording or redistributing sessions independently without written permission. EduLink reserves the right to disable accounts for any breach involving session recordings.

10. Technology, Access, and Limitations

EduLink is not responsible for disruptions caused by the user’s internet connection, device issues, software problems, or third-party application failures. It is the user’s responsibility to ensure they have a stable internet connection, updated software, and functional equipment prior to attending a session. EduLink may experience occasional maintenance or technical downtime, during which access may be temporarily limited. EduLink is not liable for losses resulting from such interruptions.

11. Liability and Disclaimers

EduLink provides educational services on an “as-is” basis without warranty of any kind, whether expressed or implied. EduLink does not guarantee academic improvement, grades, or exam success. Under no circumstances will EduLink be liable for indirect, incidental, or consequential damages, including but not limited to lost earnings, academic loss, or emotional distress. EduLink’s total liability for any claim will not exceed the amount paid for the service in question.

12. Suspension or Termination of Accounts

EduLink reserves the right to suspend or terminate accounts that violate these Terms, the Code of Conduct, payment policies, or safety guidelines. Reasons for termination may include (but are not limited to) abusive behaviour, fraudulent activity, unauthorised sharing of materials, multiple no-shows, or misuse of the platform. Refunds will not be provided in cases where termination results from user misconduct.

13. Governing Law

These Terms & Conditions are governed by the laws of Guyana (or the jurisdiction in which EduLink is officially registered). Any disputes arising from the use of the platform or related services will be resolved under local governing law.
